Welcome to Pressy. These Terms and Conditions govern your access to and use of our website, products and services. By accessing our website, browsing our products, creating an account, placing an order or using any part of our website, you agree to be bound by these Terms and Conditions.

For the purposes of these Terms and Conditions, “Pressy”, “we”, “us” and “our” refer to Pressy. “You”, “your”, “customer” and “user” refer to any person who accesses our website, places an order or purchases our products.

Pressy is an online retailer of premium press-on gel nails and related beauty products.

These Terms and Conditions are intended to comply with applicable South African legislation, including the Consumer Protection Act 68 of 2008, the Electronic Communications and Transactions Act 25 of 2002 and the Protection of Personal Information Act 4 of 2013.


2. Use of Our Website

You may use our website only for lawful purposes.

You agree not to:

  • use our website in any way that is unlawful, fraudulent or harmful;

  • interfere with the proper functioning or security of the website;

  • attempt to gain unauthorised access to our systems;

  • copy, reproduce, scrape, distribute or exploit website content without our written permission;

  • upload or transmit viruses, malware or harmful code;

  • use our website or content to mislead consumers or impersonate Pressy.

We reserve the right to suspend, restrict or terminate access to our website if we believe that these Terms and Conditions have been breached.


3. Eligibility

By using our website or placing an order, you confirm that:

  • you are at least 18 years old, or have the consent and supervision of a parent or legal guardian;

  • you have legal capacity to enter into a binding agreement;

  • the information you provide to us is accurate, current and complete;

  • you will update your information if it changes.


4. Product Information

We make every reasonable effort to ensure that all product descriptions, images, prices, availability and other information on our website are accurate and up to date.

However, you acknowledge that:

  • product colours may appear differently depending on screen settings, device display, photography lighting and natural lighting;

  • packaging may vary slightly from time to time;

  • product images are for illustrative purposes;

  • measurements, descriptions and wear-time claims are approximate;

  • availability may change without notice;

  • minor product improvements or updates may be made from time to time.

We do not guarantee that your screen’s display of any colour will be completely accurate.


5. Colour Disclaimer

Pressy makes every effort to photograph and display product colours as accurately as possible. However, actual product colours may vary depending on:

  • screen brightness;

  • device display settings;

  • colour calibration;

  • flash or studio lighting;

  • natural sunlight;

  • indoor lighting;

  • surrounding colours and shadows.

Colour variation caused by lighting, screen settings or photography does not constitute a defect.


6. Product Use

Pressy products must be used strictly in accordance with the instructions provided on our website, packaging and tutorial videos.

For best results, customers should:

  • ensure their hands, nails and workspace are clean and dry;

  • remove dirt, dust, oils, creams and residue before application;

  • push back cuticles before application;

  • clean the natural nail thoroughly with the prep pad where supplied;

  • select the correct nail size for each finger;

  • avoid overlapping the nail onto the skin and apply the Pressy the correct way around;

  • press firmly for the recommended time;

  • avoid water, oils, creams and lotions immediately after application;

  • follow removal instructions carefully.

Incorrect preparation, application, after-care or removal may affect wear time and may affect the condition of the natural nail.


7. Wear Time Disclaimer

Pressy products are designed to provide beautiful, convenient, damage-free-looking gel nails when applied and removed correctly.

However, individual wear time varies from person to person.

Factors that may affect wear time include:

  • nail oil levels;

  • nail texture;

  • nail shape;

  • nail length;

  • nail flexibility;

  • lifestyle;

  • occupation;

  • hand washing frequency;

  • exposure to water;

  • exposure to oils, creams, lotions or sunscreen;

  • application technique;

  • nail preparation;

  • after-care;

  • removal method.

Any advertised wear time, including “up to 14 days”, is an indication of potential wear time and is not a guarantee that every customer will achieve the same result.


8. Allergies, Sensitivities and Nail Health

Some individuals may be sensitive or allergic to adhesives, acrylates, cosmetic ingredients or nail products.

We recommend a 'patch test' of Pressy products if:

  • you have an allergy or known sensitivity to adhesives, acrylates or nail products;

  • your natural nails are damaged, infected, inflamed, painful or lifting;

  • the skin around your nails is broken, irritated, bleeding or infected;

  • you have an active nail infection or suspected nail condition.

Discontinue use immediately if you experience redness, itching, swelling, burning, discomfort, irritation or any adverse reaction.

If symptoms persist or worsen, seek medical advice.

Pressy products are cosmetic products and are not intended to diagnose, treat, cure or prevent any medical condition.


9. Product Safety

Pressy products are intended for external cosmetic use only.

Please:

  • keep products out of reach of children and pets;

  • do not ingest;

  • avoid contact with eyes;

  • store products in a cool, dry place away from direct sunlight;

  • do not use products for any purpose other than their intended cosmetic use;

  • dispose of packaging responsibly.


10. Orders

When you place an order on our website, you are making an offer to purchase the selected products.

Your order is only accepted once:

  • payment has been successfully received; and

  • we confirm or begin processing your order.

We reserve the right to refuse, cancel or limit any order where:

  • stock is unavailable;

  • payment cannot be verified;

  • fraud or suspicious activity is suspected;

  • incorrect information has been provided;

  • there is an obvious pricing, product or website error;

  • delivery is not possible to the address supplied;

  • we are legally required to do so.

If we cancel an order after payment has been received, we will refund the amount paid for the cancelled item or order.


11. Pricing

All prices are listed in South African Rand.

Prices may change at any time without notice.

The price payable is the price displayed at checkout at the time you place your order, subject to correction of obvious errors.

Promotional prices are valid only during the stated promotional period or while stocks last.


12. Payment

We accept the payment methods displayed at checkout.

Payments are processed through secure third-party payment providers. Pressy does not store your full card details.

Your order will only be processed once payment has been successfully authorised or received.

If payment is declined, reversed, flagged or not completed, we may cancel or suspend the order.


13. Discount Codes and Promotions

Discount codes, bundle offers and promotions are subject to the specific terms communicated at the time of the promotion.

Unless expressly stated otherwise:

  • discount codes cannot be combined;

  • discounts cannot be applied retrospectively after an order has been placed;

  • promotions are valid while stocks last;

  • discounts cannot be exchanged for cash;

  • sale items may be excluded;

  • selected products may be excluded;

  • Pressy may amend, suspend or cancel promotions at any time.

Where a refund is processed for an order purchased using a discount, the refund will be based on the discounted amount actually paid.


14. Stock Availability

All products are sold subject to availability.

Adding a product to your cart does not reserve stock.

If an item becomes unavailable after your order is placed, we may offer you:

  • a replacement product;

  • store credit;

  • a refund for the unavailable item;

  • cancellation of the affected part of the order.


15. Shipping and Delivery

We deliver to the areas displayed at checkout.

Delivery times are estimates only and are not guaranteed.

Delivery may be affected by:

  • courier delays;

  • public holidays;

  • strikes;

  • high order volumes;

  • incorrect address details;

  • weather events;

  • power outages;

  • system disruptions;

  • circumstances beyond our reasonable control.

Pressy is not liable for delays caused by courier partners or events outside our control, but we will assist where reasonably possible. Please note that couriers do not collect or deliver on weekends or public holidays. 


16. Delivery Address and Failed Delivery

You are responsible for providing a complete and accurate delivery address, contact number and delivery instructions.

Pressy is not responsible for failed, delayed or misdirected deliveries caused by:

  • incorrect address details;

  • missing unit, complex, office, suburb or postal code information;

  • unreachable contact numbers;

  • refusal to accept delivery;

  • failure to collect or receive the parcel;

  • customer unavailability.

Additional courier charges resulting from incorrect information, failed delivery attempts or re-delivery may be charged to the customer.


17. Risk and Ownership

Ownership of the products transfers to you once full payment has been received.

Risk in the products passes to you once the order has been delivered to the delivery address provided, collected by you, or received on your behalf by another person at the delivery address.


18. Returns, Refunds and Exchanges

We want you to love your Pressy order. However, because our products are cosmetic and hygiene-sensitive, returns must be handled carefully.

This section sets out our returns, refunds and exchanges policy and forms part of these Terms and Conditions.


18.1 Change-of-Mind Returns

If you change your mind about your purchase, you may request to return eligible products within 7 days of receiving your order, provided that the product is:

  • unused;

  • unopened;

  • in its original sealed packaging;

  • in a resellable condition;

  • complete with all original contents, accessories, inserts and packaging;

  • not damaged, altered or tampered with.

For hygiene reasons, we cannot accept change-of-mind returns of opened, used or unsealed products unless the product is defective, damaged or incorrectly supplied.

Change-of-mind returns are subject to inspection and approval.

The customer is responsible for the direct cost of returning the goods, unless the return is due to an error by Pressy or a defective, damaged or incorrectly supplied product.


18.2 Cooling-Off Period for Online Purchases

Where applicable under South African law, customers may have the right to cancel an online transaction within the prescribed cooling-off period.

If you exercise a valid cooling-off right:

  • the product must be returned to us;

  • the product must be unused and in its original condition;

  • you may be responsible for the direct cost of returning the goods;

  • we will process any refund due once the returned goods have been received and inspected.

This does not apply where the law permits exclusions or where products cannot be returned for hygiene, safety or other lawful reasons once opened or used.


18.3 Hygiene-Sensitive Products

Pressy products include cosmetic and hygiene-sensitive items that come into contact with the hands, nails and skin.

For health and hygiene reasons, we do not accept returns, refunds or exchanges on products that have been:

  • opened;

  • used;

  • worn;

  • applied;

  • removed from their original packaging;

  • tampered with;

  • damaged after delivery;

  • exposed to unhygienic handling;

  • returned incomplete.

This restriction does not apply where the product is defective, unsafe, damaged on arrival or incorrectly supplied, and where you are entitled to a remedy under applicable law.


18.4 Defective Products

If you believe a product is defective, please contact us as soon as reasonably possible at info@pressy.co.za.

A defective product is a product that has a material fault or manufacturing defect and does not meet the quality, functionality or safety that a customer is reasonably entitled to expect.

A product will not be considered defective merely because:

  • the colour appears slightly different due to lighting or screen settings;

  • wear time varies between customers;

  • the product was incorrectly applied;

  • the product was applied on to split, damaged, weak or brittle nails;
  • the natural nail was not properly prepared;

  • after-care instructions were not followed;

  • the product was damaged through misuse, negligence or normal wear and tear;

  • the customer selected the wrong size or style;

  • the customer no longer likes the colour or style after opening.

If a product is confirmed to be defective, we will provide the remedy required by applicable law, which may include repair, replacement or refund.

We may require photographs, videos or return of the product for inspection before approving a refund, replacement or exchange.


18.5 Damaged on Arrival

If your order arrives damaged, please contact us within 7 days of delivery at info@pressy.co.za.

Please include:

  • your order number;

  • clear photographs of the damaged product;

  • clear photographs of the outer courier packaging;

  • clear photographs of the inner packaging;

  • a description of the issue.

Please do not discard the product or packaging until we have reviewed your claim.

If the product was damaged before or during delivery, we may offer a replacement, refund or store credit, depending on the circumstances and stock availability.


18.6 Incorrect Items Received

If you receive the wrong product, please contact us within 7 days of delivery.

Please include:

  • your order number;

  • a photograph of the item received;

  • a photograph of the packing slip or order confirmation, if available.

If we confirm that the incorrect product was supplied, we will arrange an appropriate remedy, which may include sending the correct product, arranging collection of the incorrect product, issuing a refund or providing store credit.

Products sent in error must be returned unused, unopened and in their original packaging unless we advise otherwise.


18.7 Missing Items

If an item is missing from your order, please notify us within 7 days of delivery.

Please include:

  • your order number;

  • photographs of the products received;

  • photographs of the packaging;

  • details of the missing item.

If we confirm that an item was omitted from your order, we will either send the missing item, provide a refund for that item, or offer store credit.


18.8 Exchanges

Exchanges may be offered at our discretion for eligible unopened products.

To qualify for an exchange, the product must be:

  • unused;

  • unopened;

  • sealed;

  • in original packaging;

  • complete;

  • in resellable condition.

The customer may be responsible for return courier costs and any additional delivery charges for the replacement item, unless the exchange is due to a Pressy error or defective product.

Exchanges are subject to stock availability.


18.9 Bundle, Promotional and Discounted Orders

If you return an item purchased as part of a bundle, promotion, gift-with-purchase offer or discount campaign, the refund may be recalculated to reflect the value of the products actually kept.

For example:

  • if a bundle discount was applied, the refund may be reduced proportionately;

  • if a free item was received, the free item may need to be returned unused and unopened;

  • if the free item is not returned, its value may be deducted from the refund.

Promotional items, sale items or limited-edition products may be marked as final sale where permitted by law.


18.10 Products That Cannot Be Returned

Unless required by law, we do not accept returns of:

  • opened Pressy nail sets;

  • used Pressy nail sets;

  • products that have been applied or worn;

  • products removed from sealed packaging;

  • products damaged after delivery;

  • products returned incomplete;

  • products affected by misuse, incorrect application or incorrect removal;

  • products exposed to water, oils, creams, heat or unhygienic handling after delivery;

  • sale or clearance items marked as final sale;

  • gift cards or vouchers.


18.11 How to Request a Return

To request a return, email info@pressy.co.za with:

  • your full name;

  • order number;

  • product name;

  • reason for return;

  • photographs, where relevant;

  • whether you are requesting a refund, replacement, exchange or store credit.

We will review your request and provide instructions if the return is approved.

Please do not send products back without contacting us first. Returns sent without prior approval may not be accepted.


18.12 Return Courier Costs

Return courier costs are handled as follows:

  • for change-of-mind returns, the customer is responsible for the direct cost of returning the product;

  • for approved defective products, damaged-on-arrival products or incorrect items, Pressy will cover reasonable return or replacement courier costs where required;

  • if a returned product is inspected and found not to qualify for a refund, replacement or exchange, the customer may be responsible for the cost of returning the product back to them.


18.13 Inspection of Returned Products

All returned products are subject to inspection.

We reserve the right to refuse a refund, exchange or replacement if:

  • the product has been opened or used;

  • the product is not in its original condition;

  • the product is missing parts or packaging;

  • the product was damaged after delivery;

  • the product shows signs of misuse, incorrect application or incorrect removal;

  • the return request falls outside the applicable return period;

  • the product does not meet the requirements of this policy.

If a return is declined, we will notify you.


18.14 Refund Method and Timing

Approved refunds will be processed using the original payment method where possible.

Refunds may take several business days to reflect, depending on your bank or payment provider.

Delivery fees are not refundable for change-of-mind returns unless required by law or unless the return is due to an error by Pressy.


18.15 Store Credit

In some cases, we may offer store credit instead of a refund, where permitted by law and accepted by the customer.

Store credit:

  • is not redeemable for cash;

  • may be subject to an expiry date where communicated;

  • may be used only on the Pressy website;

  • cannot be transferred unless we agree otherwise.


19. Cancellations

If you wish to cancel an order, please contact us as soon as possible.

We cannot guarantee cancellation once an order has been processed, packed, dispatched or handed to the courier.

If cancellation is possible, we will refund the amount paid.

If the order has already been dispatched, you may need to follow the returns process set out above.


20. Customer Content, Reviews and Testimonials

If you submit a review, testimonial, photograph, video, social media post, comment or other content relating to Pressy, you grant Pressy permission to use, reproduce, share, publish, edit and display that content for marketing, advertising and promotional purposes, unless you expressly tell us otherwise in writing.

You confirm that any content you submit:

  • is truthful and based on your own experience;

  • does not infringe anyone else’s rights;

  • is not unlawful, defamatory, abusive, offensive or misleading.

We reserve the right to remove, moderate or decline to publish customer content.


21. Intellectual Property

All content on our website and social media platforms, including but not limited to:

  • logos;

  • brand names;

  • product names;

  • product photographs;

  • packaging designs;

  • graphics;

  • videos;

  • written copy;

  • website layout;

  • icons;

  • marketing material;

is owned by or licensed to Pressy and is protected by intellectual property laws.

You may not copy, reproduce, modify, distribute, publish, display or use our intellectual property without our prior written consent.


22. Privacy and Personal Information

We respect your privacy and process personal information in accordance with applicable South African data protection laws.

We may collect and process personal information for purposes including:

  • processing orders;

  • delivering products;

  • communicating with customers;

  • managing returns and refunds;

  • improving our website;

  • sending marketing communications where permitted;

  • complying with legal obligations;

  • preventing fraud.

By using our website and submitting your personal information, you consent to the processing of your personal information for these purposes.


23. Cookies

The website may be unavailable from time to time due to:

  • maintenance;

  • updates;

  • technical issues;

  • hosting problems;

  • internet disruptions;

  • cyber incidents;

  • circumstances beyond our control.

We are not liable for any loss arising from website downtime or technical errors, except where liability cannot lawfully be excluded.


27. Errors and Inaccuracies

We reserve the right to correct any errors, inaccuracies or omissions on our website, including errors relating to:

  • pricing;

  • product descriptions;

  • promotions;

  • availability;

  • delivery fees;

  • images;

  • specifications.

If an error affects an order you have placed, we will contact you where reasonably possible and may cancel or amend the order, subject to applicable law.


28. Limitation of Liability

To the fullest extent permitted by law, Pressy will not be liable for any indirect, incidental, special or consequential loss or damage arising from:

  • inability to use our website;

  • use or misuse of our products;

  • incorrect application or removal;

  • failure to follow instructions;

  • courier delays;

  • loss of profits;

  • loss of business;

  • loss of data;

  • unauthorised access to your account caused by your failure to keep login details secure.

Nothing in these Terms and Conditions excludes or limits any liability that cannot legally be excluded or limited under South African law.


29. Indemnity

You agree to indemnify and hold Pressy harmless against any claims, losses, damages, liabilities, costs or expenses arising from:

  • your breach of these Terms and Conditions;

  • your misuse of our website;

  • your misuse of our products;

  • your violation of any law;

  • your infringement of any third-party rights.


30. Force Majeure

Pressy will not be liable for any delay or failure to perform where such delay or failure is caused by events beyond our reasonable control, including but not limited to:

  • natural disasters;

  • extreme weather;

  • pandemics;

  • epidemics;

  • war;

  • civil unrest;

  • strikes;

  • courier disruptions;

  • power outages;

  • internet outages;

  • government action;

  • import delays;

  • customs delays;

  • supplier delays;

  • system failures.


31. Changes to These Terms and Conditions

We may update these Terms and Conditions from time to time.

Continued use of our website after changes are published means that you accept the updated Terms and Conditions.


32. Governing Law

These Terms and Conditions are governed by the laws of the Republic of South Africa.

Any dispute relating to these Terms and Conditions, our website or our products will be subject to the jurisdiction of the appropriate South African courts or consumer authorities.
